ITSA provides guidance in the table below, which refers to various Commonwealth and State payments and/or grants for financial assistance relating to natural disasters, on how these payments and/or grants will be treated in bankruptcy.
The approach adopted is to suggest that trustees would make an assessment with the individual circumstances of each bankrupt in mind while adopting a compassionate approach, as appropriate. Accordingly, a case by case assessment is recommended.
