Official Receivers are appointed by the Attorney-General
pursuant to section 16 of the Bankruptcy Act 1966.

Official Receivers have various powers and functions under the Bankruptcy Act, including:
- assessing and registering bankruptcy and personal insolvency agreement applications from debtors
- registering court-ordered insolvency administrations
- issuing bankruptcy notices on the application of creditors
- issuing statutory notices to obtain information and/or recover monies on the application of trustees administering insolvent estates
- administering the debt agreement provisions of the Bankruptcy Act, including assessing debt agreement proposals against statutory requirements and conducting the voting process on proposals, and
- maintaining the National Personal Insolvency Index, the public register of personal insolvencies
There are currently two Official Receivers:
- Andrew Robinson - who is National Manager Information & Registries business line; and
- Cheryl Cullen – who is Acting National Manager of ITSA’s Trustee Services business line
