Overseas Travel

Any person who is an undischarged bankrupt must obtain written permission from their trustee to leave Australia.
The trustee of the bankruptcy may impose written conditions where consent is given to travel. This may include payment of any contributions liability as assessed before permission is granted (see current amounts for current income threshold amounts).
If you leave Australia without your trustee's permission or you leave with permission but do not return when you said you would, your trustee may lodge an objection to your discharge. If this happens, your bankruptcy will be extended by five years from the date you return to Australia.
If you are overseas and your trustee asks you to return to Australia and you do not, your trustee may lodge an objection to your discharge. If this happens, your bankruptcy will be extended by eight years from the date you return to Australia.
Permission is not required once a person is discharged from bankruptcy or the bankruptcy has been annulled.
A debtor who has entered a formal arrangement with creditors under either a Part IX debt agreement or a Part X Personal Insolvency Agreement is not restricted from leaving Australia.

A written request for consent to leave Australia should be made to the trustee well in advance of the proposed departure.
The trustee should be supplied with:-
- reasons for departing Australia
- dates of departure and return
- details of the itinerary and any overseas contact details
- particulars about who will fund travel costs
- any documentary evidence supporting the request eg confirmation by an employer of the need to travel, confirmation of payment of costs by a third party
The trustee may refuse consent where the bankrupt's presence is necessary for the proper and efficient administration of the bankruptcy.
If consent is granted, the trustee must do so in writing before departure.
