There are a number of agencies who provide assistance to people in financial difficulty.

Financial Counsellors

Financial counselling services help people who are in financial difficulty.
  • They are available in every state and territory and provide a free, independent and confidential service.
  • They can help you manage a short-term crisis and plan to prevent a future one.
  • Financial counsellors can help you remain independent and take full control of your own financial affairs.
  • Some financial counsellors assist people to establish Part IX Debt Agreements.
  • Many financial counsellors are free or charge nominal fees.

Registered Trustees

Registered Trustees are bankruptcy and personal insolvency specialists. They are registered to administer bankruptcies and Part X Debt Agreements.
Registered trustees charge for providing specialist advice, however some registered trustee may provide initial consultations for no fee.
Only licensed practitioners are permitted to have control of the administration of Bankruptcies or Part X agreements.
These persons are registered through ITSA and are referred to as Registered Trustees.

Debt Agreement Administrators

Debt Agreement Administrators can assist you to enter into Part IX Debt Agreements and then act as administrator of the agreement.
Fees are generally charged for the initial assistance and the continuing administration.

Insolvency and Trustee Service Australia (ITSA)

The Insolvency and Trustee Service Australia is a Commonwealth Government Agency.
It is Australia’s personal insolvency regulator and administers 95% of all bankruptcies.
ITSA can provide information about the Bankruptcy Act 1966 and related legislation.
We are able to inform you on what your rights and obligations are. We cannot advise you on which insolvency solution best suits your circumstances.

  • Bankruptcy Regulation is divided into three areas, North West Region; Central Region and Southern Region. Please choose the appropriate region when making contact.
  • The Enforcement area is primarily responsible for compliance with the personal insolvency-related offence provisions contained within the Act. This includes the identification and investigation of material offences under the Act and where appropriate, the preparation of briefs of evidence for prosecution by the Commonwealth Director of Public Prosecutions.

The Federal Court and Federal Magistrates Service are the two primary Courts that have jurisdiction in matters associated with the Bankruptcy Act 1966.
